This paper aims to provide a brief overview of housing disrepair, including whether a landlord or tenant is responsible for defects to a property, the reasons why, and the ways in which landlords and tenants may be able to take legal action to put things right.

Disrepair is a common cause of disputes between landlords and tenants and can be a particularly frequent problem during winter and autumn. As damp and mould growth is often a cause of disputes, this paper will focus mainly on damp and mould to highlight some broader disrepair issues.
